These Terms are an agreement between you and Buildday LLC (“Brief”, “we”). They cover your use of:
- brief.cv and app.brief.cv;
- the Brief mobile app;
- Brief NFC cards and tags;
- page.fyi links (together, “Brief”).
By creating an account or using Brief, you agree to these Terms and to our Privacy Policy.
1. Your account
- You must be at least 13 years old, or 16 in the EEA/UK, and able to form a binding contract.
- Keep your sign-in details secure. You’re responsible for activity on your account. Tell us at hello@brief.cv if you suspect misuse.
- Accounts created on page.fyi continue on Brief under these Terms.
- One login can hold several cards, including team cards. If you use Brief for an organization, you confirm you’re authorized to act for it.
2. Your content
- You keep ownership of what you add, such as photos, text, links and logos.
- You give us a worldwide, non-exclusive, royalty-free license to host, store, display and share that content. This license is only to operate Brief: showing your card to the people you share it with, generating QR codes and contact files, and backups.
- You’re responsible for your content. You must have the rights to it, and it must be accurate and lawful.
3. Contacts you receive
People who view your card may send you their contact details. Use them only to follow up in ways they’d reasonably expect, and in line with applicable law, including anti-spam and privacy law. Don’t sell them, and don’t add them to marketing lists without consent.
4. Acceptable use
Don’t use Brief to:
- break the law, infringe others’ rights, or impersonate anyone;
- harass people, send spam or unsolicited messages, or collect people’s data without permission;
- share malware, phishing, or deceptive links;
- probe, overload or disrupt Brief;
- scrape it at scale;
- get around security or usage limits.
We may remove content or suspend accounts that break these rules.
5. NFC cards and tags
- A Brief card or tag works by opening a web link. It keeps working as long as Brief operates the link.
- You can change which card a device opens, or deactivate it, at any time. If a device is lost or stolen, report it in Devices so taps stop opening your profile.
- Purchases of physical cards, when available, are covered by the terms shown at checkout. Returns and warranty terms are shown at checkout.
6. Plans and fees
- Brief’s core features are free.
- Existing page.fyi Pro accounts keep their Pro features at no charge, unless we tell you otherwise with reasonable notice.
- If we introduce paid plans, prices and billing terms will be shown before you buy, and you can cancel at any time.
7. Third-party services
Brief lets you link to, or sign in with, other services such as Google, Apple and social networks. Their terms and privacy policies govern your use of them.
8. Ending your account
- You can delete your account at any time in Settings.
- We may suspend or end accounts that violate these Terms, or if required by law. Where reasonable, we’ll give notice.
- Sections 2 (license, for backups only until they’re overwritten), 3, and 9 to 12 survive.
9. Disclaimers
Brief is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We don’t guarantee that Brief will be uninterrupted or error-free.
10. Limitation of liability
To the fullest extent permitted by law:
- Brief won’t be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill.
- Our total liability for any claim relating to Brief is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $100.
11. Indemnity
You’ll defend and indemnify Brief against third-party claims arising from your content or your breach of these Terms.
12. Governing law and disputes
These Terms are governed by the laws of the State of Texas and the Federal Arbitration Act, excluding conflict-of-laws rules.
Try to resolve it informally first. Before filing a claim, email hello@brief.cv describing the dispute, and give us 60 days to try to resolve it.
Arbitration. If we can’t resolve a dispute informally, you and Buildday LLC agree to resolve it by binding individual arbitration, not in court. This covers any dispute arising out of or relating to Brief or these Terms.
- The American Arbitration Association (AAA) runs it under its Consumer Arbitration Rules.
- It takes place in Dallas County, Texas, or by video or phone.
- An arbitrator can award the same individual relief a court could.
- Fees follow the AAA Consumer Rules, which set the share each party pays.
- Frivolous claims: if the arbitrator finds a claim, or the relief sought, frivolous or brought for an improper purpose (measured by the standard in Federal Rule of Civil Procedure 11(b)), the arbitrator may order the claimant to pay all arbitration fees and Buildday LLC’s reasonable costs and attorneys’ fees.
Exceptions. Either party may:
- bring an individual claim in small-claims court;
- seek a court order to stop infringement or misuse of intellectual property.
No class actions. Claims may be brought only individually, not as a plaintiff or class member in any class, consolidated or representative proceeding. If this class-action waiver is found unenforceable for a claim, that claim goes to court, not arbitration.
Opt out within 30 days. You can opt out of this arbitration agreement within 30 days of first accepting these Terms. Email hello@brief.cv with your name, your account email and a statement that you opt out.
Courts. Any dispute that isn’t arbitrated will be resolved in the state or federal courts located in Dallas County, Texas.
13. Changes
We may update these Terms. If a change is material, we’ll give notice in the app or by email before it takes effect. Continuing to use Brief means you accept the updated Terms.
